    Employer of Record for a UK Technology Company Hiring Namibian Engineers

    The Client

    A UK-based technology company specialising in remote infrastructure monitoring that had identified three Namibian engineers to hire for a long-term project supporting telecommunications clients across southern Africa.

    The Challenge

    The company had no Namibian entity and had attempted to hire the engineers as independent contractors. After taking legal advice, it concluded that the arrangement constituted employment under Namibian labour law and created permanent establishment risk. It needed a proper employment solution in Namibia within five weeks to meet the engineers' start dates. Incorporation of a local entity would have taken longer and created ongoing compliance obligations the company was not ready to manage.

    Our Approach

    We provided an Employer of Record solution, acting as the legal employer for all three engineers in Namibia. We prepared employment contracts compliant with the Namibian Labour Act, registered each employee for PAYE and SSC, processed monthly payroll, and provided the UK company with a monthly recharge invoice covering gross salaries, employer SSC contributions, and our EoR fee. We also prepared briefing notes for the UK HR team on Namibian leave entitlements, termination procedures, and the annual increment obligations under the Labour Act.
